Last year, Michigan
Public Act 280 of 2014 imposed more stringent requirements for background
checks for applicants seeking to obtain a pharmacy license. The new regulations require the inclusion of background
checks and fingerprints for all members of the Board of Directors for applying
entities. This has proven to be particularly challenging for health systems
whose bylaws require public members to sit on their Boards.
Since that time, Senate
Bill (SB) 195 has been introduced, seeking to revise the regulations around
which individuals actually require background checks as part of the application
process. The current version of SB 195 reflects a complete deletion of the
background check requirement for owners., MPA, the Michigan Association of
Health Plans (MAHP) and others are advocating for an amendment that corrects the problem but still applies
the appropriate level of scrutiny to applicants for pharmacy licenses to ensure
that individuals who have physical access to medications are appropriately
screened.
